We have been able to secure both a date for the hearing to certify a class of all those flooded by the work the State has done on Interstate highway 10, and a date for trial. The class certification hearing will be June 14, 2022, at the United States Courthouse in Houston in Courtroom 600. All are welcome to attend. While there is usually plenty of room in the courtroom, please contact the court for details on entry. We would love to see you there!
The trial is currently set for June 2023. We still face an uphill battle to get there. Although we defeated the State’s attempt to have your claims dismissed in the trial court, the State has appealed that decision to the federal court of appeals. That fight is currently being waged while we work on the trial court at the same time. We hope to get a (favorable!) decision later this year.
Meanwhile, we are still pushing the case in the trial court as well. The experts we have hired are building models and preparing reports, for submission in September. These are huge undertakings and critical to our success.
